Article 2. Livestock

The governing body of the City of Morland, in order to provide for its citizens, allow for the protection and regulation of health and safety hazards, and to maintain the City in general, has deemed it necessary to restrict and/or prohibit the keeping, ownership, or location of certain animals within the confines of the City of Morland, Kansas.

It shall be unlawful for the owner, lessee, occupant, tenant, or other person in charge of the real estate or premises located within the city limits of the City of Morland, Kansas, to possess, keep or maintain livestock within the city, or permit to be kept, possessed or maintained therein any stable, shed, pen or other place where such livestock may be kept. For the purposes of this article, livestock shall mean horses, mules, donkeys, ponies, cattle, sheep, goats, swine, or other undomesticated animals. This provision shall not apply to:

(a)   The maintaining of a stockyard or sales barn for the loading, unloading, temporary detention and sale of livestock, if the location of such stockyard or sales barn does not otherwise violate the zoning ordinances of the City of Morland, Kansas;

(b)   The maintain of dogs, cats, or other domesticated animals or pets, the same to be in conformance with the other ordinances and resolutions of the City of Morland, Kansas, and the laws of the State of Kansas and the United States of America.

(c)   The transporting of animals through the City of Morland by ordinary and customary means.

(d)   The maintaining of fowl, including chickens, ducks, geese, turkeys, and guinea fowl, as long as the same comply with the other ordinances and resolutions of the City of Morland, Kansas, and the laws of the State of Kansas and the United States of America.

(e)   Anyone owning and maintaining livestock within the city limits of Morland, Kansas, as of the effective date of Ordinance No. 11-02, so long as the ownership and maintenance of said livestock complies with other ordinances and resolutions of the City of Morland, Kansas, and the laws of the State of Kansas and the United States of America. Provided, however, that should said livestock die or be sold, said owner shall not be allowed to replace said livestock after August 9, 2011.

(f)   Any person or entity granted permission by the City of Morland to allow for the ownership, maintenance, keeping and/or storage of livestock. No person shall be allowed to possess or keep livestock within the city limits of the City of Morland prior to being granted said permission, and the same must be requested at a regularly scheduled meeting of the City Council for the City of Morland, Kansas, with opportunity to provide citizens within the City of Morland to attend said meeting and be heard on the request for permission.

In the event any livestock is kept or possessed within the city limits of the City of Morland, and in violation of the above law, the City of Morland, its employees and representatives, is authorized to remove the livestock and charge the costs and expenses of said removal to the owner of the livestock.

Any person convicted of violating this article shall be fined a sum not to exceed $25.00 per animal.
